Terms of Service

These Terms of Service ("Terms") govern your access to and use of GetRightOut.com and the GetRightOut platform ("Platform"). By accessing or using GetRightOut, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. License to Use

GetRightOut grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for your personal, non-commercial purposes. This license does not include the right to:

• Modify, reverse engineer, or create derivative works of the Platform
• Rent, lease, or sublicense the Platform or its content
• Remove copyright, trademark, or proprietary notices
• Reproduce, distribute, or publicly display the Platform's content without permission
• Use the Platform for any commercial purpose without prior written consent

2. Prohibited Activities

You agree not to:

• Use bots, crawlers, spiders, or other automated tools to scrape, download, or index Platform content without permission
• Create an account or use the Platform for the purpose of data harvesting or competitive intelligence
• Bypass, disable, or interfere with the Platform's security, rate-limiting, or authentication features
• Collect email addresses, usernames, or other personal data of GetRightOut users
• Build a competing service or database by reproducing GetRightOut's aggregated event data
• Remove or obscure attribution to source venues, artists, or data providers
• Use the Platform in any manner that violates applicable law
• Interfere with or disrupt the Platform's operation or user experience

Violation of these prohibitions may result in immediate account termination and may trigger legal action for breach of contract.

3. Intellectual Property Rights

GetRightOut retains all rights, title, and interest in the Platform, including all content, design, code, and functionality. All content on the Platform — including event listings, descriptions, artwork, editorial text, source code, and design elements — is owned by GetRightOut or its licensors and protected by copyright, trademark, and patent laws.

The compilation, selection, and coordination of event data is a protected derivative work under copyright law. While individual facts (event dates, venue names) may not be copyrightable, systematic reproduction of the entire aggregated database for commercial purposes constitutes copyright infringement.

"GetRightOut" and the GetRightOut logo are trademarks of GetRightOut, Inc. Unauthorized use of these marks is prohibited.

4. User-Generated Content

If you submit feedback, corrections, suggestions, or other content to GetRightOut ("User Content"), you grant GetRightOut a worldwide, perpetual, royalty-free license to use such User Content. You represent that you have the right to grant this license and that your User Content does not infringe third-party rights.

5. Data and Privacy

Your use of GetRightOut is also governed by our Privacy Policy. Please review it carefully.

6. Accuracy of Information

GetRightOut aggregates event information from multiple sources. While we strive to provide accurate information, event details can change at any time. Always confirm show dates, times, and details directly with the official venue before attending. GetRightOut makes no warranty, express or implied, regarding the accuracy, completeness, or reliability of event listings.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GETRIGHTOUT AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or opportunity
• Business interruption or service outages
• Errors, omissions, or inaccuracies in event information
• Your reliance on the Platform's content
• Third-party content or services

THIS LIMITATION APPLIES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow exclusion of certain damages, so some limitations may not apply to you.

8. Affiliate Links

GetRightOut may earn commissions from ticket sales through Ticketmaster, TodayTix, SeatGeek, and other ticketing partners. These affiliate relationships:

• Do not affect the price you pay
• Are disclosed in our Privacy Policy
• Never influence which events we recommend or feature
• Do not compromise our editorial independence

9. Account Termination

GetRightOut may terminate or suspend your account immediately, without notice or liability, if you violate these Terms or engage in conduct that we believe is harmful to the Platform or other users.

10. Changes to These Terms

GetRightOut may update these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date below. Your continued use of the Platform after changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflicts of law principles. You agree that any legal action or dispute arising out of these Terms shall be resolved exclusively in the state or federal courts located in New York, and you consent to the jurisdiction of such courts.
